SUPER FIT FIDO CLUB PRIVACY POLICY

The Super Fit Fido Club Privacy Policy describes how Super Fit Fido Club (SFFC) treats personal information when you complete the Membership Registration form on Superfitfidoclub.com. SFFC is a site for pet owners to register themselves and their dogs (Canine Members) for workout classes they will participate in together. This Privacy Policy explains how we treat the personal information you give us when you complete the Membership Registration form on Superfitfidoclub.com. Pet Owner: When you choose to complete the Membership Registration form to join group workout classes the personal information (name, email address and phone numbers) that you the pet owner voluntarily disclose online when submitting the Membership Registration form is used solely for correspondence between the pet owner and SFFC. The pet owner’s name, phone number and email address will not be on Superfitfidoclub.com website and will never be shared, rented, bartered or sold with other users or third-party companies.

Canine Member: When you choose to submit a Membership Registration for the Canine Member (your pet), the pet information (name, age and veterinarian) that you the pet owner voluntarily disclose online when completing the Membership Registration form is used solely for workout program development between the pet owner and SFFC. The Canine Member’s veterinarian and personal information will not be on Superfitfidoclub.com website and will never be shared, rented, bartered or sold with other users or third-party companies.

Legal Requests

You understand and agree that SFFC may access, preserve, and disclose your personal information if required to do so by law or in a good faith belief that such access preservation or disclosure is reasonably necessary to comply with legal process, such as a search warrant, subpoena, statute, or court order, or to protect the rights and property of SFFC or the public.

Transfer of Ownership

Please note, we reserve the right to transfer your submitted information in the event of a transfer of ownership of SFFC, such as acquisition by or merger with another company. In such an event, SFFC will notify you before information about you is transferred and becomes subject to a different privacy policy.

TERMS AND CONDITIONS OF SUPER FIT FIDO CLUB

Each person (“Pet Owner”) shall complete a Membership Registration form for the Super Fit Fido Club (“Club”) online for themselves and their dog (“Canine Member”). Upon submission of this Membership Registration form, the Pet Owner agrees to abide by the terms and conditions set forth in this agreement (“Agreement”) which are posted on the website www.superfitfidoclub.com, and which may be amended from time to time at the Club’s sole discretion. For Purposes of this Agreement, Club and Pet Owner may be individually referred to as “Party” or collectively as “Parties.”

Pet Owner’s Obligation

The Club fees are due at membership registration and are nonrefundable.

Right to Revoke or Suspend Your Membership

The Club reserves the right to revoke or suspend your membership as a Pet Owner, without refund, at the Club’s sole discretion, at any time in the event that you or your Canine Member engages in behavior that is unsafe or objectionable to other Pet Owners or Canine Members, for reasons of nuisance or disturbance to other Pet Owners or Canine Members, or fraud.

Member’s Health Warranty

Pet Owner represents that Pet Owner and Pet Owner’s Canine Member is in good health and has no disability, impairment, injury, disease, or ailment, preventing him or her, or it, from engaging in active or passive fitness training or which could cause increased risk of injury or adverse health consequences as a result of fitness training. Pet Owner assumes full responsibility for his or her participation, including the Canine Member’s participation in fitness training classes, and shall hold harmless and release Club, its agents, representatives, and employees, against any and all liability arising out of participation in Club activities or fitness training classes. Physical examinations by your physician and veterinarian are recommended for all Pet Owners and Canine Members before commencing any fitness training classes or participating in Club activities, and especially for Pet Owners or Canine Members who are at risk, including but not limited to Pet Owners or Canine Members unaccustomed to physical exertion, or who have physical limitations, a history of heart problems or other chronic illnesses.

Medical Disclaimer

Each Pet Owner has been informed and acknowledges that the Club has made no claims, representations or warranties as to medical or other physical results, including but not limited to weight loss, that can or may be obtained through participation in Club activities or fitness training classes. The Club has neither suggested nor will suggest any medical treatment to Pet Owners of Canine Members, or to Canine Members. Only licensed physicians or veterinarian professionals are qualified to give medical advice. Pet Owners of Canine Members are instructed not to act on the advice given unless such advice has been verified by their licensed physician or veterinarian professional. Any information, advice or recommendations provided by Club during Club activities or fitness training classes are for general informational purposes only, and are not intended to substitute any advice from your physician/qualified health care provider or veterinarian. Each Pet Owner of a Canine Member represents that there are no medical or physical conditions that would preclude the participation of Pet Owner or Canine Member in fitness training classes, and each Pet Owner of a Canine Member further represents that he/she has not been instructed by any licensed physician or veterinarian not to participate in fitness training classes.

Orientation

Pet Owners and their Canine Members are required to take the initial orientation class to ensure the proper and safe participation in Club activities or fitness training classes.

Assumption of Risk and Release

Pet Owner acknowledges and agrees that any athletic or physical activity involves certain risks. Pet Owners of Canine Members assume the risk of any and all loss, theft, cost, claim, liability, accidents or injuries (including damage to persons, pets, or property) of any kind that may be sustained by Pet Owners, duly authorized representatives of Pet Owners, or Canine Members, or in connection with, participation in Club activities or fitness training classes, and shall hold harmless and release, discharge and forever absolve the Club, its agents, representatives, or employees, from any loss, theft, claims, liabilities, injuries, suits, demands, judgments, costs and expenses (including attorneys’ fees and costs of defense) of any kind which may result or arise out of any alleged negligence caused or alleged to have been caused by Club, its agents, representatives, or employees in the performance of this Agreement, or as a result of participation in Club activities or fitness training classes, or the omission of any act or responsibility by Club, its agents, representatives, or employees under this Agreement. Pet Owner agrees to defend Club, its agents, representatives or employees against any such liability, claim or demand.

GENERAL PROVISIONS

Compliance with Club Terms and Conditions

All Pet Owners shall abide by the Club terms and conditions of this Agreement, any Club policies, and amendments and/or modifications thereto.

Dress Code for Club Fitness Training Classes

Proper athletic attire is required of the Pet Owners and safe, canine equipment is necessary for all Canine Members. The Club reserves the right to make the final determination in its sole discretion with regard to appropriate attire and canine equipment.

Club Fitness Training Class Policies

Each Club fitness training class package is limited to a set number of participants. Pet Owners and Canine Members should not join a fitness training class late or leave a fitness training class early without the instructor’s consent. No one will be admitted ten (10) minutes after the scheduled fitness training class time. If you are just starting a Club fitness training class or have an injury or problem that may prevent full participation, please discuss this with the Club instructor before fitness training class. Proper clothing and footwear must be worn in all Club fitness training classes by the Pet Owner and the Canine Member must be leashed with safe, canine equipment. The Club reserves the right to change the Club fitness training class schedule at any time. This includes the addition or the deletion of fitness training classes, as well as changes in instructors, fitness training class times and length of fitness training classes. The Club reserves the right to change Club fitness training class policies when necessary.

Personal Training

Pet Owners have the option of personal Canine Member fitness training sessions at an additional cost to Pet Owner. Personal training is to be set up with the instructor. Personal fitness training sessions are subject to additional charge. If additional fitness training sessions are provided by Club to Pet Owner, additional Club fees are due at time service is rendered and are nonrefundable. Additional Club fitness training sessions are further subject to the terms and conditions of this Agreement.

Changing the Terms and Conditions

The Club has the right to change the terms and conditions of this Agreement at any time.

Entire Agreement

This Agreement, including any exhibits hereto, represents the entire agreement between the Parties concerning the subject matter hereof and supersedes all previous agreements and understandings, oral or written, between the Parties regarding the subject matter of this Agreement.

Governing Law

Unless governed by federal law, this Agreement shall be governed by and construed in accordance with the laws of the State of New York without regard to choice of law principles.
